Terms of Use

These Terms of Use ("Terms") form an agreement between you and Brace Labs (ABN 44 346 982 757), trading as Hound ("Hound", "we", "us" or "our"), and govern your use of the Hound mobile application, websites and related services (together, the "Services"). By creating an account or using the Services, you agree to these Terms and our Privacy Policy.
1. Eligibility and accounts
You must be at least 13 years old and legally capable of agreeing to these Terms. If you are under 18, you confirm that a parent or guardian has reviewed and agreed to these Terms where required by law.
You must provide accurate information, keep your sign-in methods and devices secure, and promptly tell us about suspected unauthorised access. You are responsible for activity through your account except to the extent caused by our failure to exercise reasonable care. You may sign in using email, Google or Apple; those providers' terms also apply to your use of their services.
2. What Hound provides
Hound helps users discover venues, events, menu items and specials; receive AI-assisted recommendations; create and share plans; invite other people; and add selected information to a device calendar. Features, geographic coverage, usage limits and membership benefits may change over time.
Hound is a discovery and planning service. Unless expressly stated, Hound is not the venue, event organiser, booking agent, merchant or payment provider for third-party offerings shown in the Services.
3. Venue, event and offer information
Information may come from venues, public websites, users and third-party data providers. Opening hours, availability, prices, menus, dietary information, event details and specials can be incomplete, delayed or changed without notice. You should confirm important details directly with the relevant venue or organiser before travelling, purchasing or relying on them.
Recommendations are general discovery suggestions, not professional, medical, dietary, travel or safety advice. You remain responsible for considering allergies, accessibility, transport, weather, venue conditions and your own circumstances.
4. AI features
Hound uses artificial intelligence to interpret requests and generate recommendations, summaries and suggested plan actions. AI output may be inaccurate, incomplete, outdated or unsuitable. It may not reflect a venue's current information and should not be treated as a guaranteed fact or instruction.
You are responsible for reviewing AI output before relying on it or sharing it. Hound applies validation and permission checks before supported plan changes, but you remain responsible for choices you make using the Services. Do not submit confidential information or personal information about another person unless you have authority to do so.
5. Plans, invitations and social features
When you create or participate in a shared plan, follow another user, respond to an invitation or make your profile public, information you contribute may be visible to the relevant users or invitees. Invitation links may be forwarded; treat an open invitation link as shareable. You must not invite, contact, impersonate, harass or share information about another person unlawfully.
Plan organisers control their plans and may change or cancel them. Hound does not guarantee that another user, venue or organiser will honour a plan, invitation or response.
6. Your content
You retain ownership of content you submit to Hound, including profile information, photos, messages, prompts and plan contributions ("Your Content"). You grant Hound a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, format, transmit and display Your Content solely as reasonably necessary to operate, secure, support and improve the Services and provide features you request. This licence ends when Your Content is deleted from our active systems, except where continued retention is legally permitted or technically necessary for backups, security records or content shared with others.
You confirm that you have all rights and permissions needed for Your Content and that it does not violate law, privacy, confidentiality, intellectual-property or other rights. We may remove or restrict content where reasonably necessary to protect users, comply with law or enforce these Terms.
7. Acceptable use
You must not:
- use the Services unlawfully, fraudulently or to harm, threaten, harass or deceive anyone;
- impersonate another person or misrepresent your affiliation, age or identity;
- upload malware or content that is unlawful, infringing, abusive or deliberately misleading;
- attempt to access another account, bypass access controls, probe vulnerabilities or interfere with operation of the Services;
- scrape, crawl, bulk-extract, reverse engineer or use automated means to access the Services except as permitted by law or with our written permission;
- use Hound output or data to build a competing dataset, directory or AI model; or
- use the Services to send spam or unauthorised commercial communications.
8. Memberships, billing and cancellation
Hound may offer a free plan and paid monthly or yearly memberships with different feature limits. Current prices, billing periods, trial terms (if any) and included features are displayed before purchase. Paid memberships in the iOS app are purchased through Apple's App Store and are subject to Apple's payment and subscription terms.
Unless the purchase screen states otherwise, a paid membership renews automatically for the same billing period until cancelled. Apple charges your Apple account and manages renewals, cancellation and eligible refunds. You can manage or cancel through your Apple subscription settings. Cancellation normally takes effect at the end of the current paid period; deleting Hound or stopping use does not itself cancel an Apple subscription.
We may change membership features or future pricing by giving any notice required by law or the applicable store. Nothing in these Terms excludes refund, cancellation or other rights that cannot lawfully be excluded.
9. Third-party services and links
The Services use or link to third-party authentication, maps, calendars, weather, venues, events, websites, booking providers and app stores. We do not control those services and are not responsible for their availability, content, transactions or conduct. Their own terms and privacy policies apply.
10. Hound intellectual property
Hound and its licensors own the Services, including software, branding, designs, databases and content other than Your Content and third-party content. We grant you a personal, limited, revocable, non-exclusive, non-transferable right to use the Services for their intended purpose while you comply with these Terms. No other rights are transferred to you.
11. Service changes, suspension and termination
You may stop using Hound at any time. You may request deletion of your account by contacting us. Account deletion does not automatically cancel a subscription managed by Apple.
We may change, suspend or discontinue a feature, or suspend or terminate access, where reasonably necessary for maintenance, security, legal compliance, protection of users, non-payment or a material or repeated breach of these Terms. Where appropriate and legally required, we will give reasonable notice and an opportunity to remedy the issue.
12. Consumer guarantees and disclaimers
Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy under the Australian Consumer Law or other law that cannot lawfully be excluded, restricted or modified.
Subject to those non-excludable rights, the Services are provided on an "as available" basis. We do not promise that all venue information or AI output will be accurate or current, that every feature will always be available, or that the Services will be uninterrupted or error-free.
13. Liability
To the maximum extent permitted by law, Hound is not liable for indirect or consequential loss, loss of opportunity, or loss arising from your dealings with a venue, organiser, merchant, other user or third-party service. We are not responsible for changes, cancellations, injury or loss caused by a third party or by relying on information that you could reasonably have confirmed directly.
Where our liability for a failure to comply with a consumer guarantee can lawfully be limited, our liability is limited, at our option, to supplying the relevant Services again or paying the cost of having them supplied again. This limitation does not apply where it would be unfair or unlawful.
14. Indemnity
To the extent permitted by law, you are responsible for reasonable loss suffered by Hound arising from your unlawful use of the Services, your material breach of these Terms, or Your Content infringing another person's rights. This does not require you to indemnify Hound for loss caused by our negligence, breach or unlawful conduct.
15. Changes to these Terms
We may update these Terms to reflect changes to the Services, providers or law. We will publish the revised Terms and change the date above. If a change is material, we will provide reasonable additional notice where required. Changes will not retrospectively remove accrued rights or apply in a way prohibited by law.
16. Governing law and disputes
These Terms are governed by the laws of New South Wales, Australia. You and Hound submit to the non-exclusive jurisdiction of the courts of New South Wales and courts entitled to hear appeals from them. Before starting formal proceedings, we encourage you to contact us so we can try to resolve the issue. This clause does not prevent you from exercising rights in another jurisdiction that apply despite this clause.
17. General
If part of these Terms is invalid or unenforceable, it will be read down or severed to the minimum extent necessary and the remainder will continue. A delay in enforcing a right is not a waiver. You may not transfer your agreement with us without our consent; we may transfer it as part of a genuine business reorganisation or sale, subject to applicable law.
